Agreement to Terms

By accessing and using Vistora ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service. These Terms apply to all users of the Service, including visitors, registered users, and any other users of the Service.

Description of Service

Vistora is an AI-powered platform that provides:

  • AI image generation and editing tools
  • AI video generation from images
  • Template-based content creation
  • Cloud storage for generated content
  • Credit-based usage system

User Accounts and Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years old to use our Service
  • One account per person; sharing accounts is prohibited
  • We reserve the right to suspend or terminate accounts that violate these Terms

Credits and Payment

Our Service operates on a credit-based system:

  • Credits are required to generate images and videos
  • Image generation: 1 credit per image
  • Video generation: 3 credits (5 seconds) or 6 credits (10 seconds)
  • Credits are non-refundable and non-transferable
  • New users receive 10 complimentary credits to get started
  • We reserve the right to modify pricing with notice

Content and Intellectual Property

Your Content

  • You retain ownership of images you upload to our Service
  • You grant us a license to process your uploads for AI generation purposes
  • You represent that you have the right to upload and use any content you provide

Generated Content

  • You own the generated images and videos created through our Service
  • Generated content is subject to the capabilities and limitations of AI models
  • We may retain generated content for service improvement and quality assurance
  • You are responsible for ensuring your use of generated content complies with applicable laws

Platform Content

  • Vistora's platform, interface, and underlying technology remain our property
  • You may not reverse engineer, copy, or create derivative works of our platform
  • Our templates and AI models are proprietary and protected by intellectual property laws

Prohibited Uses

You agree not to use the Service to:

  • Generate illegal, harmful, hateful, or offensive content
  • Create content that violates others' rights, including privacy and publicity rights
  • Generate content depicting minors in inappropriate situations
  • Create deepfakes or non-consensual intimate imagery
  • Violate any applicable laws or regulations
  • Attempt to circumvent usage limits or security measures
  • Use automated systems to generate content at scale without permission
  • Upload content you don't have rights to use

Service Availability and Modifications

  • We strive to maintain high service availability but cannot guarantee 100% uptime
  • We may modify, suspend, or discontinue features with or without notice
  • During alpha testing, the Service may have bugs or limitations
  • We reserve the right to impose usage limits to ensure fair access

Privacy and Data

Disclaimers and Limitations

AI-Generated Content

  • AI-generated content may not always meet your expectations

  • You are responsible for reviewing and approving all generated content before use

Service Limitations

  • The Service is provided "as is" without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability and fitness for purpose
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for the Service

Indemnification

You agree to indemnify and hold harmless Vistora and its affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of others.

Termination

  • You may terminate your account at any time
  • We may suspend or terminate accounts for violations of these Terms
  • Upon termination, you may lose access to generated content
  • Provisions regarding intellectual property, disclaimers, and limitations survive termination

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notifications. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration.
